Merger control in Luxembourg: climbing up the ladder
By Philippe-Emmanuel Partsch and Ursula Pereira Pinto Bassoukou(1), Arendt Medernach Luxembourg   Luxembourg Competition Authority shows it is getting ready for its upcoming merger control regime.   To date, while other countries have long-established merger control systems, Luxembourg remains the only EU Member State lacking an ex ante regime, although a draft bill of law is already under debate.   Under the Competition Law of 30 of November of 2022 (“Luxembourg Competition Law”), undertakings are not legally obliged to notify mergers or acquisitions without any EU dimension(2) to the Luxembourg Competition Authority.
