By adoption of the new law of 26 February 2021 and certain grand ducal regulations, Luxembourg has transposed the new Audio-Visual Media Services Directive (EU) 2018/1808 (the Directive) into national law.
The new law modifies the Electronic Media Act of 27 July 1992 in multiple aspects. In first instance, the legislative changes affect audio-visual media service (AVMS) providers. They will have to comply with, amongst other things, new information and reporting obligations towards the authorities, modified advertising rules, and quota to promote European works. Second, the new law aims at regulating video-sharing platform services and the providers of such platforms on which programmes and user-generated videos are shared (VSP providers).
